(AD 20) (S. Banerjee) An accommodation has been prayed for on behalf of the learned advocate on record of the petitioners.

This application under Article 227 of the Constitution of India is at the instance of the defendants praying for a direction upon the learned Civil Judge (Sr. Division), 7th Court at Alipore to dispose of T. S. No. 422 of 2019 expeditiously. In view of the orders sought and proposed to be passed, there is no necessity to direct issuance of notice upon the opposite parties. However, the petitioners shall be obliged to forward a copy of this application along with this order upon the opposite parties or their learned advocates representing them before the learned trial Judge.

It appears from the record that an application under Order 39 Rules 1 and 2, read with Section 151 of the Code of Civil Procedure filed by the petitioner herein, is pending.

Learned trial Judge is requested to take up the hearing of the application under Order 39 Rules 1 and 2 CPC and to dispose of the same as expeditiously as possible without granting any unnecessary adjournment to either of the parties, if such application is otherwise ready for hearing. With the above directions CO 616 of 2025 stands disposed of.
