This is an application under Article 226 of the Constitution of India wherein the writ petitioner is aggrieved by the inaction on the part of the respondent authorities in releasing the arrear claimed on salary of the petitioner.

I have heard counsel appearing for the parties. Accordingly, I direct the Commissioner of School Education being the respondent no. 2 to release funds as per the letter dated August 27, 2019 (Annexure - P/8 of the writ petition) within a period of three weeks from date. Upon release of the funds, the District Inspector of Schools (S.E.), Murshidabad, respondent no. 3 is directed to ensure that payment of arrear, claimed by the petitioner, is made within two weeks thereafter.

With the above direction, the writ petition is disposed of. There will be no order as to costs. 5.

Since no affidavit-in-opposition is called for, the allegations made in the writ petition are deemed not to have been admitted.

Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all necessary formalities.
