... petitioners This revisional application has been preferred challenging the investigational proceedings relating to Contai Police Station Case No.256 of 2011 dated 06.11.2011, under Sections 363/366/34 of the Indian Penal Code.
Records reflect that a coordinate Bench by order dated 05.03.2012 was pleased to observe that as the investigation of the case was under progress, no interference should be made with the continuation of the investigation but no action should be taken without the leave of the Court.
I have considered the submissions advanced in the revisional application and I find that the same relate to question of fact which is premature to be adjudicated at this stage. The investigating agency already submitted charge-sheet before the jurisdictional court.
The jurisdictional court is directed to proceed with the case and take the same to its logical conclusion. No interference is called for at this stage.
Accordingly, C.R.R.469 of 2012 is dismissed.
Pending application, if any, is consequently disposed of. Interim order, if any, is hereby vacated.
All parties shall act in terms of copy of this order downloaded from the official website of this Court.
