Kalipada Roy @ Kalu v. State Of West Bengal & ORS.
12.08.2021
IN THE HIGH COURT AT CALCUTTA
Item No.30 CRIMINAL REVISIONAL JURISDICTION Ct.No.34 dc.
C.R.R. 472 of 2012 (Via Video Conference) Kalipada Roy @ Kalu versus The State of West Bengal & Ors.
In Re: An Application under Section 482 of the Code of Criminal Procedure.
Mr. Imran Ali, Mr. Ashok Das ... For the State.
Mr. Imran Ali, learned advocate appearing for the State, submits a report of the investigating officer of the case. Let the said report dated 12.08.2021 be kept with the record. The report reflects that charge-sheet was filed on 18.04.2014 before the learned jurisdictional court. The revisional application was preferred at the stage when investigation was in progress. The orders dated 04.06.2012 and 18.06.2012 passed by a co-ordinate Bench of this Court reflect that the petitioner has never moved this revisional application before this Court.
Having regard to the fact that subsequently chargesheet has been submitted, I am of the view that the circumstances, under which the revisional application was preferred, have completely changed. As such, the revisional application is not maintainable at this stage. Accordingly, CRR 472 of 2012 is dismissed.
Interim order, if any, is hereby vacated.
All pending applications, if any, are consequently disposed of.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
