Versus

The State of West Bengal & Ors.

Mr. Bikash Goswami Mr. Chittaranjan Panda Ms. Satabdi Bhattacharya Mr. Subhendu Sanyal ...for the appellants Mr. Nilotpal Chatterjee Mr. Satyaki Banerjee ...for the Calcutta University Mr. Swapan Kr. Dutta, Sr. Adv.

Mr. Rajat Dutta ...for the State

1. The appeal is arising out of an order 17th February, 2025 passed by the learned Single Judge after taking into consideration that 300 students are likely to be affected by reason of complete negligence and inaction on the part of the appellants, permitted such 300 students to be registered and participated in the 3rd semester examination in which they shall also be permitted to sit for the 1st semester examination.

2. The directions of the learned Single Judge in this regard are reproduced below:

i) The University shall open their portal for 2 more days to enable different colleges to upload students information required for registration of students, after the first semester examinations of the University are over.

ii) Only such students will be registered who had secured admission before the last date i.e., 30.11.2024. However,

there would be no classification between the Centralized Admission Portal and the College portal.

iii) The students so registered shall be allowed to undertake their 1st semester examination along with their 3rd semester examination. It is needless to say the students must otherwise qualify to undertake such examination in terms of the University Regulation by fulfilling the eligibility criteria including as regards required attendance.

3. None of the students are before us. It is not the case that any of the students are really aggrieved by this order. In any event, having regard to the fact that the examination is going to be held tomorrow (20th February, 2025) and there is apparently a negligence on the part of the College authorities in not taking up the issue and uploading the portal as required under the relevant rules, we are not interfering with the order impugned.

4. The interest of 300 students is adequately protected in the impugned order dated 17th February, 2025. 5.

On such consideration, we affirm the order of the learned Single Judge. The appeal fails.

6.

In view of dismissal of the appeal, there is no need to pass any direction in the stay application.

7.

The application being CAN 1 of 2025 shall also stand dismissed.
