05.01.2021 Through Video Conference Item no. 17 Dd/aloke WPA 2732 of 2010 Sri Tapan Kumar Maity Vs.

The State of West Benal & Ors.

Mr. Rana Mukherjee, Ld. APP Mr. Sabir Ahmed ... ...For the State We have perused the pleadings and the material papers in this writ petition. There is no appearance for the petitioner.

The issue sought to be raised is intricately connected with matters which were pending consideration by the criminal court. The allegations raised in the writ petition are those which lie intertwined with the criminal court proceedings. There were some matters before the West Bengal Human Rights Commission also.

We do not think that, at this distant point of time, any order is called for from this Court in exercise of authority under Article 226 of the Constitution. Hence, this writ petition is liable to be dismissed.

In the result, this writ petition is dismissed. [Thottathil B. Radhakrishnan, C.J] [Rajesh Bindal, J.]
