Mr. Krishnendu Bhattacharya, Mr. Tapodip Gupta ... For the de facto complainant/Opposite Party No.2. The present case relates to Pradhan Nagar Police Station Case No. 524/2011 dated 09.12.2011 under Sections 468/471/406/420 of the Indian Penal Code.

Mr. Jayanta Narayan Chatterjee, learned advocate appearing for the petitioner earlier had drawn the attention of this Court to the contentions advanced in CRAN 3721 of 2016 wherein the complainant as also the accused person expressed their intention to compromise the disputes which cropped up.

Krishnendu Bhattacharya, learned advocate appearing for the complainant/opposite party no.2 expresses his consent regarding the contention advanced by Mr. Jayanta Narayan Chatterjee, learned advocate for the petitioner.

Earlier by an order dated 12.08.2021, a report was called for from the Inspector-in-Charge, Pradhan Nagar Police

Station. The said officer has submitted a report along with statement of the complainant/opposite party no.2 recorded on 16.08.2021.

The said report reflects that the complainant/opposite party no.2 does not intend to proceed with the case. The statement also reflects that the loan of the bank was completely diluted by one Uttam Mukherjee being husband of the present petitioner.

Having regard to the fact that the same related to OD account and the bank authorities have not suffered, I am of the view that the nature of offence complained of is private and personal in nature and as such, further continuation of the proceedings is unwarranted as the parties have effected settlement amongst them.

Accordingly, all further proceedings relating to Pradhan Nagar Police Station Case No.

524/2011 dated 09.12.2011 under Sections 468/471/406/420 of the Indian Penal Code is hereby quashed. Consequently the application being CRAN 3 of 2016 (Old No. CRAN 3721 of 2016) and CRR 487 of 2012 are allowed.

All pending connected applications, if any, are consequently disposed of.

Report dated 17.08.2021 so submitted be kept with the record.
