Mr. Amitabha Ghosh, Ms. Nabanita Chatterjee ....for the petitioner Mr. Raja Saha, Mrs. Rupsha Chakraborty ...for the State The petitioner complains of alleged inaction on the part of the Chanditala Police Station. She has complained that she is being obstructed from using a land under a leasehold estate/property. Counsel for the State submits that the police have received a report from the BL & LRO that no formal permission for conversion of the land to use it for pisciculture has been obtained. The digging up of the land for creating a pond would amount to changing the nature and character of the land. The land stands in the name of a deity (Debattar property). The name of the petitioner has not been found in the records by the BL & LRO.
In the aforesaid circumstances, the petitioner expects this Court to put a judicial seal over a gross illegality.
In the above circumstances, WPA 3063 of 2020 shall stand dismissed with costs assessed at Rs. 7,500/-, payable to the Chanditala Police Station by the petitioner.
