Mr. Jagabandhu Mondal, Mr. Nirmalendu Bera, Mrs. Kalpana Khan Mondal ....for the petitioners Affidavit of service filed in Court today is taken on record.

The petitioner no.1 complains that his father has been summoned under Section 160 of the Cr. P.C. by the Dum Dum Police Station.

The Dum Dum Police Station has filed a report dated February 24, 2023, in connection with an FIR being Dum Dum Police Station Case No. 841/2022 dated 22.12.2022 under Sections 406/420/468/471 of the IPC, which is taken on record.

It appears that the father as well as the brother of the petitioner no. 1, have refused to cooperate in the investigation.

The Dum Dum Police submits that there is substantial evidence that a sum of Rs. 30,00,000/- out of Rs. 42,00,000/- has gone into the SBI account of the petitioner.

Counsel for the petitioner submits that his client has not received a single penny from the

complainant. The petitioners are willing to cooperate in the investigation.

The petitioners shall appear before the Investigating Officer of the Dum Dum Police Station tomorrow (25.02.2023) at 11 a.m.

With the aforesaid directions, the instant writ petition shall stand disposed of.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
