For the SSC The petitioner's application for transfer has been rejected on the ground that there is a court case pending. It appears from the record that it is the petitioner who is the complainant in the said criminal proceeding.

In any event, pendency of a criminal case cannot be a ground for refusing to entertain the order of transfer in the instant case.

In those circumstances, the petitioner's application for transfer shall be resent by the Head of the Institution to the District Inspector of Schools (S.E). The District Inspector of Schools shall process the

application in terms of the 2015 Rules within the time frame stipulated therein.

With the aforesaid observations, the writ petition is disposed of.

There will be no order as to costs.

All parties are directed to act on a server copy of this order duly downloaded from the official website of this Court.
