27.06.
Ct. No.17 WPA 3091 of 2020 Sk. Wasim Kader Vs.
The State of West Bengal & Ors.
g.b.
Mr. Sunit Kr. Roy Mr. Debasis Maitra .......For the Petitioner Mr. Prosenjit Mukherjee Ms. Madhurima Sarkar .....For the Madrasah Service Commission The petitioner prays for regularization of his service in which he joined on 26.11.2006 by the Managing Committee of the Madrasah. It has not been done till date.
Learned advocate for the Madrasah Service Commission submits that he is not ready with the matter.
However, I do not think that Madrasah Service Commission has anything to do in this regard. As of now I am directing the Director of Madrasah Education being the respondent no.2 to consider the matter after giving an opportunity of hearing to the petitioner who shall have the liberty to be represented through his learned advocate and today one judgement reported in (2018) 8 SCC 238 has been placed before this court which should be placed before the said Director of Madrasah Education who
will consider the same and pass a reasoned and speaking order and will intimate the same to the petitioner within a period of fifteen days after hearing. The hearing is to be concluded by thirty days from the date of communication of this order. However, the petitioner shall not be disturbed for a period of three months from date even if the decision goes against him.
