This is an application alleging willful and deliberate violation of the order dated 1st March, 2023.

The contempt application was filed on 12th October, 2023.

The contempt application was taken up for hearing on 15th December, 2023, 18th January, 2024,13th February, 2024, 8th March, 2024, 28th March, 2024, 22nd April, 2024 and 6th May, 2024. On 6th May, 2024 Mr. Samanta, learned Advocate for the alleged contemor submitted that he has received the instruction through e-mail on that

day itself wherein it has been stated that the alleged contemnor shall comply with the order dated 1st March, 2023.

On the basis of such submission this Court directed the matter to be listed on 22nd May, 2024 for filing the affidavit of compliance.

However, when the matter is taken up for hearing today, Mr. Samanta, learned Advocate appearing for the alleged contemnor submits that a decision has been taken to challenge the order dated 1st March, 2023 but such appeal could not be filed as the file is lying in this Court. Today for the first time it has been submitted that the alleged contemnor is willing to challenge the order dated 1st March, 2023. However, since the alleged contemnor has decided to challenge the said order, let the contempt application go out of list with liberty to the petitioners to pray for enlistment upon notice to the learned Advocate for the alleged contemnor.
