S.De (rejected) (Via Video Conference) CRM No. 1795 of 2021 In Re: An Application for Anticipatory Bail under Section 438 of the Code of Criminal Procedure filed on 11.02.2021 in connection with Kotulpur Police Station Case No. 151 of 2018 dated 28.09.2018 under Sections 341/323/325/332/333/308/506/34 and adding Section 304A of the Indian Penal Code.

The petitioners have been charged under various provisions of the Penal Code. The allegation is that the petitioners caused grievous bodily harm to the victim who was in hospital for about fifteen days. Thereafter, he was discharged but ultimately died. Section 304A of the Code has been added subsequently.

We have considered the material in the case diary. We have seen the injury report, the post mortem report as also

statements of witnesses recorded under Section 161 of the Code of Criminal Procedure.

The victim was a surveyor working in the office of the B.D.O. He was assaulted when he was discharging his official duties.

Considering the nature and gravity of the allegation and the material on record and the fact that investigation is still going on, we are not inclined to allow the petitioners' prayer for anticipatory bail.

Accordingly, C.R.M. 1795 of 2021 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. (Suvra Ghosh, J.) (Arijit Banerjee, J.)
