The Superintendent of Police, Baruipur Police District has filed a report dated 9th March, 2023 and the same is taken on record.

It appears that on the complaint of the petitioners, a GD Entry was made and Sonarpur P.S. NCR No.96/23 dated 8th February, 2023 has been registered and proceedings under Sections 107 and 116 of the CrPC have been taken out.

Third parties have, however, registered a complaint against the petitioners, which was registered as Sonarpur PS Case No.129/23 dated 6th February, 2023 under Sections 420 and 406 of the IPC. The complaint alleged that the petitioners have taken sums of money from them, which amounted to Rs.53 lakhs inclusive of interest. Notice under Section 41(A) of the CrPC was issued on the petitioners in connection with the said FIR.

This Court is satisfied with the report of the Superintendent of Police, Baruipur Police District. It is ordered that the investigation to the FIR being Sonarpur PS Case No.129/23 dated 6th February, 2023 is completed

as expeditiously as possible.

The petitioners shall cooperate with the investigation. They may not be interrogated more than two hours on any two days in a week.

With the aforesaid directions, the writ petition shall stand disposed of.

There shall be no order as to costs.
