By filing this public interest litigation the petitioner alleges that the private respondents have illegally cut down 190 years old living tree 'Bat' and other big living Akashbani trees. When the public of the area raised objection they were threatened with dire consequences and filthy language was used against ladies and common people belonging to a particular samaj. In this regard representations have been made to various authorities.

Learned advocate appearing for the private respondents submitted that application was given to the Divisional forest Officer, Purba Medinipur Division and permission has been granted and requisite fee has also been remitted. However, the document which is produced before this Court by the

private respondents shows any acknowledgement of the application but no copy of the fruitful order has been produced.

In any event, since we are inclined to dispose of the writ petition without calling for affidavit, we direct the concerned authority to take note of the representation of the petitioner, conduct an enquiry and thereafter proceed to take action in accordance with law if it is found that felling of trees has been done without permission or if permission has been obtained for trimming of trees and trees have been severely chopped off. This direction be complied with by the sixth respondent, namely, the Divisional Forest Officer, Purba Medinipur Division within two weeks from the date of receipt of the server copy of this order after notice to the petitioner as well as private respondents, namely, the respondent nos.15 to 21 and after which an order shall be passed. A copy of the order shall be communicated to the petitioner by registered post.

With the aforesaid direction, this writ petition is disposed of.
