The petitioners challenged the memo no.

21(3)/LA/NH2/BWN/12 dated January 10, 2021 issued by the National Highway Authority, under the National Highways Act, 1956 in an earlier writ petition being WP 5304 (W) of 2012.

The said writ petition was disposed of by the judgment and order dated September 20, 2019 by granting liberty to the petitioners to approach the competent authority under National Highways Act, by filing detailed representation ventilating their grievances.

In terms of the said order the petitioners gave their representation and the competent authority considered the said representation.

The grievance of the petitioners in the present writ petition is that no decision on the said representation has been communicated to them till date.

The petitioners by the present writ petition is praying a direction upon the said competent authority the respondent no. 3 herein, to communicate his said decision.

Mr. Ayan Banerjee, learned counsel along with Mr. Suman Banerjee, appearing on behalf of the competent authority submits that the respondent no. 3 has already disposed of the said representation of the petitioners.

He through his junior present in Court hands over a copy of the order disposing the said representation of the petitioners to Mr. Pinaki Dhole learned advocate for the petitioners.

A copy of the said order is also filed in Court today which is taken on record.

In view of such development of the matter, no further order need be passed in the present matter.

WPA 4691 of 2021 is thus disposed of.

No order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
