(Through Video Conference) WPA No. 3845 of 2022 Pandian Periyakaruppan Vs.

CESC Limited and another Mr. Indranil Halder ...for the petitioner.

Mr. Rajiv Lall ...for the CESC Limited.

Learned counsel for the petitioner contends that on the ground that the new electricity connection, if given, may result in a splitting of load, the CESC Limited has refused the petitioner's request for a new electricity connection in the petitioner's name. Learned counsel appearing for the CESC Limited takes a preliminary objection as regards the matter is being adjudicable before the appropriate authority, as stipulated in the West Bengal Electricity Regulatory Commission Regulations.

The said objection is sustained on merit.

Accordingly, WPA No. 3845 of 2022 is disposed of with liberty to the petitioner to approach the concerned Grievance Redressal Officer (GRO) with the dispute as agitated in the present writ petition. If so approached, the GRO shall, upon giving adequate hearing to all the interested parties,

including the CESC Limited and the petitioner, decide the issue in accordance with law, as expeditiously as possible, preferably within five weeks from date of such reference to the GRO concerned.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
