The petitioners are working as Paddy Purchase Personnel under the department of Food and Supply, Government of West Bengal on contractual basis. They claim the benefit of the Circular of the Government of West Bengal issued in September, 2011 and as modified from time to time, allowing certain benefits to casual daily rated employees.

It is submitted that since after filing of the writ petition, the Registrar for Food and Supply Department, Government of West Bengal has issued an order dated 6th February, 2021 extending benefits to persons who are working on contractual basis subject to terms and conditions.

In those circumstances, the writ petition is disposed of directing the respondent nos. 2

and 3 to consider the case of the petitioners for entitlement under the aforesaid Circular.

If the petitioners are indeed entitled to such benefits, the respondent nos. 2 and 3 shall pass suitable orders within a period of four months from the date of communication of a copy of this order and the same may be communicated to the petitioners within fifteen days thereof.

No order as to cost.

Photostat certified copy of this order, if applied for, be given to the parties upon compliance of all formalities.
