For the State The grievance of the petitioner is directed against the refusal of the State authorities to release compensation in favour of the petitioner in respect of the subject acquisition proceedings. It is submitted on behalf of the petitioner that notwithstanding the petitioner having made a representation as far back as on 3rd April, 2018 (appearing as Annexure P/4 to the writ petition) the State respondents have not taken any steps to dispose of or consider the representation of the petitioner.
Mr. De. appearing on behalf of the State respondents files a status report inter alia, highlighting that in respect of the subject acquisition proceedings a final award has been passed in the name of one Maity family and one Bag family. It also appears from the status report that the award of Prafulla Kr. Bag is lying as not verified owing to the absence of any claimants at the time of hearing.
In view of the aforesaid, Mr. De. learned advocate appearing for the State submits that he has no objection if the representation of the petitioner be considered in accordance with law.
In view of the submissions made on behalf of the State, I direct the respondent No. 3 to consider and dispose of the aforesaid representation (appearing as Annexure P/4 to the writ petition) within a period of three months from date after giving rights of hearing to all the affected parties. It is made clear that I have not gone into the merits of the case and the respondent No. 3 is not to be influenced by any observation or finding made in this order. With the aforesaid directions, W.P.A. 3038 of 2019 is disposed of.
There shall be no order as to costs.
