Despite service, none appears for the borrowers although the State and petitioners are represented through counsel at the time of call. Affidavit-of-service filed today be kept on record. 2.

The innocuous prayer of the petitioners/Bank is that the application pending at the behest of the Bank under Section 14 of the SARFAESI Act, 2002 has not yet been disposed of although the statutory outer limit has expired.

Keeping in view the above circumstances, WPA No. 4072 of 2023 is allowed, thereby directing respondent no.3, that is, the District Magistrate, South 24 Parganas to dispose of the application pending at the behest of the petitioners under Section 14 of the SARFAESI Act, 2002 as expeditiously as possible, positively within three

weeks from the date of communication of this order to respondent no.3.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
