Heard the learned advocates appearing for the respective parties.

The petitioner is aggrieved for non-consideration of his representation dated January 30, 2021 by the respondent no.3, whereby the petitioner had made a request for resumption of the stopped increment in terms of the Government Order being Memo Number 756SC/GMISC/68/S/249 dated September 11, 2019. The petitioner submits that upon having completed a two years diploma Course, the petitioner is entitled to resumption of the annual incremental benefits in terms of the said memo dated September 11, 2019.

Having heard the learned advocates for the respective parties and having considered the material available on record, it would be proper to dispose of this writ petition by directing the respondent no.3 to consider

the petitioner's representation dated January 30, 2021 and dispose of the same by passing a reasoned order strictly in accordance with law, upon giving an opportunity of hearing to the petitioner, within a period of three weeks from the date of communication of this order. The respondent no.3 shall communicate such reasoned order to the petitioner within a week of passing thereof. It is made clear that this Court has not gone into the merits of the petitioner's case and all points are kept open to be decided by the respondent no.3 strictly in accordance with law.

With the aforesaid observations, WPA 4702 of 2021 is disposed of.

There shall, however, be no order as to costs. Urgent certified photocopy of this order, if applied for, be supplied as expeditiously as possible. (Om Narayan Rai, J.)
