The petitioner prays for implementation of the order of self-demolition passed by Howrah Municipal Corporation. The property in question presently falls under jurisdiction of Bally Municipality.

It appears that the person responsible for making construction being aggrieved by the order of selfdemolition has preferred statutory appeal before the Civil Judge (Junior Division), 6th Court, Howrah being Title Suit No. 542 of 2023.

The appellate forum by an order dated 18.3.2023 was pleased to pass an ad interim order.

As it appears that a statutory appeal has been preferred against the order of self-demolition, accordingly,

the parties are directed to agitate their grievance before the appellate forum.

Report filed by the Sub Assistant Engineer, Bally Municipality dated 25th April, 2023 be retained with the records.

Copy of the report be circulated amongst all the parties.

The writ petition stands disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
