1. None appears on behalf of the appellant.

2. In pursuance of the direction passed by this Court dated 14.07.2025 an administrative notice was issued to serve it upon the appellant as well as to the respondent through the learned Chief Judicial Magistrate, Kolkata vide memo no. 3815 Cr(A), dated 31.07.2025.

3. A compliance report has been received to that effect, transpiring that the respondent/accused has already been expired. Copy of certificate of death has been enclosed with the report which also affirms the death of the said accused/respondent. As the sole respondent/accused has been expired during pendency of this appeal the instant appeal stands abated against him.

4. Accordingly, the instant appeal be and the same is hereby dismissed as abated and the connected application being CRAN 1 of 2010 (Old No: CRAN 1936 of 2010) is also dismissed.

5. Let a copy of this order along with the Trial Court Records be sent down to the Trial Court immediately.
