Patra Ms. Supriya Dubey ....for the SSC The writ petition was heard at length in presence of the learned advocates representing the petitioner and the West Bengal Central School Service Commission on 19th April, 2023 when on behalf of the Commission certain documents were produced including e-mail letter dated 09th February, addressed to the Assistant Secretary, State Public Information Officer, West Bengal Regional School Service Commission, Northern Region. Having seen the contents of this letter this Court granted opportunity to the learned advocate representing the petitioner to obtain instructions relating to the grievance which has been canvassed in this writ petition that appropriate question booklet was not supplied to the petitioner.
Today, matter is fixed for final consideration.
When the matter is taken up for consideration accommodation has been prayed for on behalf of the petitioner which has been refused.
Considering the prayer couched in the writ petition it appears that main grievance of the petitioner is non supply of question booklet in connection with petitioner's participation in 1st RLST (NT)-2010. It was contended on behalf of the petitioner that though question booklet was supplied to the petitioner but the said question booklet was not the same booklet which was supplied to the petitioner at the time of writing examination.
On production of documents on the last occasion by the Commission which are question booklet, letter dated 4th February, 2015 issued by the Assistant Secretary of the Commission and e-mail letter dated 9th February, 2015 of the petitioner addressed to the Assistant Secretary being the SPIO of the Commission this Court does not require any further clarification from the learned advocate representing the petitioner. On mere perusal of the letter dated 9th February, 2015 goes to show that there is clear admission on the part of the petitioner that a sample question booklet of third series was supplied to him and it was the same question booklet which was supplied by the invigilator during examination.
In view of aforesaid situation, this Court does not find any merit in the writ petition. Accordingly, the same stands dismissed.
However, there shall be no order as to costs. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
