Petitioner(s) Ms. Joyta Ray ... for the Petitioner(s) Ms. Baishali Basu Mr. Sharequl Haque ... for the State-respondent(s) Learned advocate for the petitioner submits that the petitioner was arrested on 06.12.2024 and since then she is in custody. Learned advocate added that similarly placed accused person has been granted bail by this Hon'ble Court, as such, he prays that as there is no possibility of the trial commencing in the near future, the petitioner - who is suffering from Tuberculosis and is unable to avail any treatment, may be enlarged on bail.
Learned advocate for the State has drawn the attention of the court to the statement of the victim. However, I find that the petitioner's name is appearing as an individual involved in an offence of immoral trafficking.
Having considered the same, I am not inclined to enlarge the petitioner on bail.
Hence, the prayer for bail of the petitioner is Rejected.
However, if the petitioner applies before the learned Special Court for necessary treatment to be afforded to her, the learned Special Court would pass necessary directions after assessing the genuinity of the same for affording treatment to the present petitioner.
Accordingly, CRM(M) 509 of 2026 is dismissed. Pending application(s), if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
