Learned advocate appearing for the petitioner submits that the petitioner is in custody for four years and there has been no progress in trial. The evidence which has subsequently surfaced is to the advantage of the present petitioner.

Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that out of thirteen witnesses nine witnesses have already been examined and evidence of P.W. 10 is in progress. Having considered the advance stage of the case, I am not inclined to release the petitioner on bail. However, the learned Trial Court would ensure that within a period of six months the evidence of prosecution witnesses are

completed. With the aforesaid observation, the application for bail, being C.R.M. 524 of 2026, is, thus dismissed. The State is granted liberty to communicate this order to the learned Trial Court.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
