The State and the Panchayat are not represented despite service.

The petitioner and the private respondent are admittedly co-sharers of the plot in question which is undivided and undemarcated property. A civil suit is pending between them. The petitioner alleges that the private respondent is raising construction in a portion of the plot without obtaining any sanction from the concerned Panchayat. The petitioner seeks to submit a comprehensive representation before the concerned authority in this regard and seeks a direction upon the authority to consider the same.

Learned counsel for the private respondent submits that the private respondent has raised construction in 2021 in terms of the sanctioned building plan granted by the concerned Panchayat in this regard.

Be that as it may, since the petitioner seeks to submit a comprehensive representation before the concerned

authority ventilating his grievance, such liberty is granted. The petitioner shall submit a comprehensive representation before the Pradhan, Dhoradaha-II Gram Panchayat, being the 7th respondent herein, within a fortnight from date. The 7th respondent is directed to consider and dispose of the same within six weeks from the date of receipt thereof upon granting reasonable opportunity of hearing to all concerned including the petitioner and the private respondent, in accordance with law.

The decision taken by the authority shall be communicated to the parties within a week thereof. The writ petition is thus disposed of.

There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
