Heard learned Advocate for both the parties.

In this revisional application the order dated January 17, 2020 as passed by the learned Rent Controller, Kolkata in Case No. 170 of 2004 (Smt. Vandana Agarwalla & Anr. Vs. Parrichand Ghoshal) has been impugned.

The aforementioned case being case No. 170 of 2004 was filed by the opposite parties herein being the landlord of the suit premises for fixation of fair rent. By the impugned order learned Rent Controller has allowed a petition for amendment which has been challenged before this Court at the instance of the tenants who are petitioners before this Court.

It is fairly submitted at the Bar that during the pendency of the instant revisional application learned Rent Controller has disposed of Case No. 170 of 2004 by an order dated June 30, 2022.

Such being the position, this Court finds that in the present revisional application nothing remains to be

determined now since the revisional application has become infructuous in the meantime.

With the aforementioned observation, the instant revisional application being CO 617 of 2020 is dismissed. 7.

However, there shall be not order as to costs. 8.

Interim order, if there be any, as passed in this case stands hereby vacated.

9.

Parties to act on the server copies of this order. 10.

Urgent photostat certified copies of this order, if applied for, be supplied to the parties upon compliance with all the necessary formalities.
