The challenge in the present writ petition has been preferred against a final assessment order passed by the West Bengal State Electricity Distribution Company Limited (in short 'WBSEDCL'). Since such an order is appealable as per the extant Regulations framed by the West Bengal Electricity Regulatory Commission (WBERC) within the ambit of the Electricity Act, 2003, WPA No. 3884 of 2022 is disposed of with liberty to the petitioner to approach the appellate authority with the same grievance, as urged in the present writ petition, subject to the law of limitation and in accordance with law.

If so approached, the appellate authority shall decide the dispute, adhering to the relevant law, as expeditiously as possible, preferably within five

weeks from the date of such reference to the appellate authority.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
