Sukumar Dey v. State Of West Bengal & ANR
31.10.2022 Item no.42.
Court No.35.
I.T C.R.R 362 of 2016 Sukumar Dey -Vs.- State of West Bengal & Anr.
None appears on behalf of the petitioner, thus the matter is pending in the list for several days and has been called on regularly. Hence, without wasting much time the same is taken up for disposal.
Petitioner prays for quashing of the proceeding and setting aside of the charge sheet dated 31st August, 2014 in connection with GR Case No.1353 of 2011.
The case was lodged by the opposite party no.2 under Section 498A IPC, alleging torture in her matrimony by the accused persons/petitioners who are her matrimonial family members.
Petitioners ground of filing the present revision case are concoction and fabrication of the entire allegations against them. Petitioners have prayed for quashing of the proceedings, now pending in the trial court.
Record reveals that the nature of the offence as alleged against the petitioners is of sufficient gravity. Moreover, the petitioner's contentions and grounds are not based upon cogent reasons or the legal principle.
Therefore, I do not find any merit in the present revision case and the revisional application being CRR 362 of 2016 is dismissed.
