The petitioner is the mother of two minor children. The petitioner prays for an expeditious disposal of the application under Section 12 of the Guardians and Wards Act filed by the petitioner in Misc. Case (Act VIII) No.41 of 2019 pending before the learned Additional District Judge, Fast Track 1st Court at Barasat, District 24-Pargans (North). By the said application, the petitioner has prayed for restoration of the custody of the minor children, namely Md. Shakibul Islam and Sahibab Parvin under Section 12 of the said Act VIII.

Without going into the merits of the application filed by the petitioner and without making any observation on the contentions made in the same, this revisional application is disposed of with a direction upon the learned Court below to dispose of the application within a period of two months from the next date fixed upon affording an opportunity to the opposite party.

It is made clear that the learned Court below shall proceed solely on the merits of the said application, independently and in accordance with law.

The learned Advocate-on-record for the petitioner is directed to serve a copy of this revisional application upon the opposite party as also the learned Advocate appearing in the learned Court below along with a server copy of this order within a week from date.

The revisional application is disposed of.

There will be, however, no order as to costs. Urgent photostat certified copy of this order, if applied for, be given to the parties on priority basis. (Shampa Sarkar, J.)
