For the Private Respondent Nos. 3 to 8 The grievance of the petitioner is directed against the refusal of the CESC Ltd. to provide a separate connection at the premises of the petitioner. The respondent CESC is represented and submits that the private respondents have not permitted the representatives of the CESC to make necessary inspection for providing such electric connection. It is also submitted on behalf of the CESC that the petitioner has not been able to comply with the necessary requirements stipulated in the letter dated 15th May, 2019 i.e meter board shed has not been extended, KIOSK for Street Lightning service has not been installed and Main Switch has not been installed. The petitioner submits that the necessary requirements as stipulated in the letter dated 15th May, 2019 have since been complied with.

The private respondents are represented and submits that the petitioner intends to open a 'Hukka Bar' and for that reason that there will be annoyance and nuisance in the neighbourhood.

Counsel on behalf of the petitioner submits that his client has no intention of opening a 'Hukka Bar'. Heard the parties.

In view of the fair submissions made on behalf of the CESC, I am of the view that the respondent CESC should be directed to provide a fresh connection to the petitioner in accordance with law after the petitioner has complied with all statutory formalities. In providing such electricity connection to the petitioner, the Officerin-charge, Entally Police Station is directed to give all assistance to the officers of the respondent CESC, if so required.

The aforesaid exercise must be completed by the respondents within a period of four weeks from date. With the aforesaid directions, W.P.A. 4737 of 2021 stands disposed of.

There shall be no order as to costs.

Photostat certified copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
