The petitioner alleges that his prayer for issuance of credential certificate is pending consideration at the end of the Managing Director, South Bengal State Transport Corporation (SBSTC). For not possessing the said credential certificate, the petitioner is not in a position to participate in the tender processes conducted by the aforesaid authority.

The petitioner has also prayed for a direction upon the authority to permit him to participate in the tender processes anticipating that the credential certificate will be issued by the authority.

Learned counsel representing SBSTC submits, upon instructions that, admittedly the credential certificate is yet to be issued in favour of the petitioner.

Upon hearing the parties it appears that as the

credential certificate is yet to be issued in favour of the petitioner, accordingly, the petitioner cannot be treated eligible to participate in the tender processes. As and when the certificate, if any, is issued, it will be open for the petitioner to participate in future tender processes.

Accordingly, the Managing Director, SBSTC is directed to take a decision on the application made by the petitioner for issuance of credential certificate in his favour at the earliest but positively within a period of four weeks from the date of communication of this order.

The writ petition is disposed of.
