Case No.272 of 2025 dated 06.11.2025 under Sections 126(2)/115(2)/117(2)/118(2)/109/324(4)/ 303(2)/351(2)(3)/3(5) of the BNS, 2023.

And In the matter of:Ajit Ghosh and others ... petitioners Mr. Moyukh Mukherjee Ms. Sagnika Banerjee ... for the petitioners Mr. Sandip Chakraborty Mr. Karan Bapuli ... for the State Learned counsel for the petitioners submits that the petitioners are members and supporters of the opposition political party in the State. The Block President of the ruling party of the locality assaulted the petitioner No.5, his mother and some others. The complaint from the side of the petitioners was not taken as the first one. It was registered later. Therefore, the present case is effectively a counter blast to the allegations levelled by the petitioners. Learned counsel for the State opposes the prayer for anticipatory bail. He relies on the statements of the victim and other witnesses and the injury report.

Although the other injury reports show abrasions and small cut injuries recorded as simple, surprisingly, a

lacerated injury on a little finger, without any fracture, has been recorded as grievous.

Be that as it may, considering the above and the other materials available in the case diary, while I am inclined to grant anticipatory bail to the petitioners, their movement shall remain restricted for a limited period. In the event of arrest, the petitioners shall be released on bail upon furnishing a bond of Rs.10,000/- (rupees ten thousand) each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the BNSS, 2023 and on the further conditions that the petitioners shall cooperate with the investigation, shall meet the investigating officer once a week till submission of report in final form, shall stay outside the jurisdiction of Patrasayer Police Station for a period of three months except for meeting the investigating officer or attending the jurisdictional court and shall not threaten or intimidate witnesses.

The application for anticipatory bail is, thus, allowed. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
