The complaint filed by the petitioner before the Commissioner, Howrah Municipal Corporation in October 2020 is yet to be considered.

Learned advocate representing the Howrah Municipal Corporation submits that steps will be taken for consideration of the same.

The affidavit-of-service filed in Court does not bear proof of service of the writ petition upon the respondent nos. 5, 6 & 7.

In view of the order that I propose to pass, no prejudice shall be caused to the non-appearing respondents, if the writ petition is disposed of in the following manner.

The writ petition is accordingly disposed of by directing the Commissioner, Howrah Municipal Corporation or his delegate to consider the objection filed by the petitioner in October 2020 in accordance with law after giving reasonable opportunity of hearing

to all the necessary parties and pass a reasoned order and communicate the same to the parties.

The aforesaid exercise shall be concluded positively within a period of twelve weeks from the date of communication of a copy of this order.

The writ petition stands disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
