It is contended on behalf of the petitioners that the plot of land owned by the petitioners was acquired by the State respondents vide L. A. case No.
10(iv)/2010-11 and the petitioners were intimated that a sum of Rs.54,83,678/- had been decided as compensation payable to the first petitioner and a sum of Rs.70,73,536/- to the 2nd petitioner. The said compensation was not paid to the petitioners and subsequently a revised compensation was issued in favour of the petitioners which depicted an amount lesser than that of the earlier compensation. Being aggrieved by the said assessment the petitioners filed an application before the Authority
under Section 18 of the Land Acquisition Act, 1894 for reference to the Court for assessment of the same. The petitioners complain that the said application has not been referred till date.
Upon consideration of the submissions made on behalf of the parties, the writ petition is disposed of directing the 2nd respondent to refer the L.A. case to the Land Acquisition Court, Purulia under Section 18 of the Land Acquisition Act, 1894 within two weeks from the date of communication of this order.
W.P.A. 3897 of 2022 is thus disposed of.
There shall be no order as to costs.
Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.
Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
