Kausik (Allowed) CRM (DB) 724 of 2025 With CRAN 4 of 2025 In Re: An Application for bail under section 439 of the Code of Criminal Procedure 1973/Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Ekbalpur Police Station Case No. 78 of 2012 dated 11.03.2012 under Sections 302/34 of the Indian Penal Code, 1860 and Sections 25(1)(a)/27 of the Arms Act, 1959.

The interim bail was granted on 05.03.2025 after 11 years and 8 months of custody and the same has been extended from time to time.

Report has been submitted on behalf of the State. Report reflects that on 26.10.2025 one of the petitioner again entered the jurisdiction of Ekbalpur Police Station and threatened elder sister of a witness on gun point. Over this issue, a separate case vide Ekbalpur PS Case No. 374 dated 27.10.2025 has been registered for investigation.

State submits that petitioners lastly met with the Officer-in-Charge of Nadial Police Station on 02.11.2025. The petitioner's prayer for interim bail dated 05.03.2025 is confirmed subject to the same terms and conditions as earlier passed by this Court. If the Investigating Officer or the prosecution so feels so far as the conditions are concerned, application may be made to the learned Trial Court. Learned Trial Court, if required, would be in a position to add some more reasonable restrictions if he deems fit and proper as at this stage I find that the case is fixed for arguments on behalf of the accused person.

No unnecessary adjournment be granted to any of the parties. Learned Trial Court would put in efforts to pronounce the verdict by 28.02.2026.

Accordingly, CRAN 4 of 2025 is disposed of. CRM (DB) 724 of 2025 is allowed.

Report so submitted be kept with the record.
