Petitioner is in custody for 112 days. He submits he is a toto driver. There was a dispute over fare and he had no intention to murder. Accordingly, he prays for bail. 2.

Learned Advocate for the State opposes the bail prayer.

We have considered the materials on record. Petitioner had hit the victim on the head with a wrench i.e. iron spanner. As the assault was on a vital part of the body with a hard object, we are not inclined to grant bail to the petitioner at this stage.

Accordingly, the prayer for bail of the petitioner is rejected.
