The dispute raised by the petitioner pertains to a billing dispute.

It is submitted on behalf of the petitioner that in respect of the arrear demands, the WBSEDCL has no authority to claim late payment surcharge beyond two years. The petitioner also relies on a decision passed by the District Consumer Disputes Redressal Forum dated 11.01.2017.

On behalf of the WBSEDCL, it is submitted that the petitioner has an alternative statutory remedy and the matter should be referred to the concerned Grievance Redressal Officer (GRO).

In view of the statutory embargo, WPA 3823 of 2017 is disposed of by directing the GRO to consider the grievance of the petitioner.

Liberty is granted to the petitioner to take all available points in accordance with law before the GRO.

It is made clear that there has been no expression on the merits of this case and all issues are left open for the GRO to decide in accordance with law.

The above exercise is to be completed within a period of four weeks from the date of communication of this order.
