...for the petitioners This application under Article 227 of the Constitution of India is at the instance of the decreeholder praying for a direction upon the learned Civil Judge (Sr. Division), Sealdah to dispose of Misc. Case No. 2 of 2022 expeditiously.

Learned advocate appearing for the petitioners submits that the suit was decreed ex parte in favour of the petitioners. The opposite-party filed an application under Order 9 Rule 13 of the Civil Procedure Code which was registered as Misc. Case No. 2 of 2022. He submits that the opposite-party was directed to show-cause and on March 25, 2026 such show-cause was filed and September 19, 2026 has been fixed for acceptance of the show-cause.

In view of the order sought and proposed to be passed, there is no necessity to direct issuance of any notice upon the opposite party. However, the learned advocate-on-record of the petitioners shall be obliged to forward a copy of this application along with this

order, upon the opposite party or upon the learned advocate representing them before the learned trial judge.

In the light of the submission made by the petitioners CO 640 of 2026 stands disposed of by requesting the learned Civil Judge (Sr. Division), Sealdah to take up the matter for acceptance of the show-cause filed by the opposite-party on the next date and to make an endeavour to dispose of Misc. Case as expeditiously as possible without granting any unnecessary adjournment to either of the parties subject to the decision taken on the show-cause. (Hiranmay Bhattacharyya, J.)
