It appears from the said written instructions that the petitioner is entitled to get the benefits due and payable to a Chief Administrative Officer attached to the District Judgeship of Purulia from the period of April 1, 2003 till January 31, 2006. The petitioner has retired from service of January 31, 2006. The petitioner's case is that the petitioner is to receive the benefits in terms of office Memorandum dated May 31, 2018 from the pre revised scale of Rs.8000/- to 13,500/- under WBS (ROPA) Rules 1998 to revised pay band 4, i.e. Rs. 15,600/- - Rs.42000/- plus Grade pay of Rs.5400/- under WBS (ROPA) Rules, 2009. The recommendation of Shetty Commission was directed to be implemented and petitioner be given the benefits of ROPA 2009.

Therefore, this Court directs the differential amount in respect of salary, arrears and pension is to be paid to the petitioner within a period of three months from date.

With the directions aforesaid WPA 3142 of 2019 is disposed of.

Since affidavits have not been invited in the present writ petition, the allegations made in the writ petition are deemed not to have been admitted by the parties.
