29.02.2024 sdas rejected C.R.M.(NDPS) No. 365 of 2024 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Domkal Police Station Case No. 440 of 2021 dated 25.07.2021 under Sections 21(c )/29 of the NDPS Act.

And In Re : Pintu Ali .... Petitioner Mr. Debanshu Ghorai Mr. Anisur Rahman ....for the petitioner Mr. Soumik Ganguli ...... for the State 1.

Learned Counsel for the petitioner has prayed for bail on the ground of delay in trial.

Learned Counsel for the State opposes the prayer for bail and submits bail prayer of the petitioner was rejected earlier in June, 2023 and trial court was requested to conclude trial preferably within one year. Time frame has not expired as yet.

3. We have considered the materials on record. 116 bottles of Phensedyl Syrup were recovered from the petitioner and coaccused. His bail prayer has been rejected earlier on merits. On the score of delay we note time frame proposed by this Court to conclude trial has not expired as yet. Under such circumstances, we are not inclined to grant bail to the petitioner at this stage.
