Mr. Srinath Singha Roy ....for the State The petitioner claims to be the owner of L.R. Plot No.6972 and 6975 within Mouza-Mayahowri under Police Station-Bakultala in the District of South 24-Parganas. The petitioner alleges that the respondent authorities have laid pipelines through the aforesaid property of the petitioner for supply of water without initiating any proceeding for acquisition and requisition. In the report filed by the State it has been stated that the pipeline for service connection passes through the land bearing Dag No.6976 and not through the Dag No.6972 and 6975 and the owner of the land being Dag No.6976 has consented for laying of the service pipeline through his land to get household tap connection. The report further states that a survey was done in presence of Amin of both side organized by the concerned Prodhan. From the memo dated February 26, 2026, issued by the Prodhan, it prima facie appears to this Court that a
survey was made in respect of plot No.6976. No demarcation report has been produced by the respondent to show that demarcation exercise was undertaken in respect of plot Nos.6972 and 6975.
Since the grievance of the petitioner is that the pipelines have been laid through his property and a representation has been submitted to that effect by a letter dated October 15, 2025, WPA 4253 of 2026 stands disposed of by directing the Assistant Engineer, Public Health Engineering Department, Baruipur, being the respondent No.8 to consider the representation of the petitioner dated October 15, 2025 and after conducting necessary enquiries and demarcation by engaging competent Amin/Surveryor to dispose of the representation of the petitioner by passing a reasoned order after affording an opportunity of hearing to the petitioner, private respondents and any other person, who may be affected by such decision and/or their authorised representatives. The entire exercise shall be completed within a period of 8 weeks from the receipt of a server copy of this order along with a copy of the representation dated 15.10.2025.
Needless to mention that the work of demarcation shall be carried out after prior notice to the respective parties. The demarcation report along with the sketch map shall also be supplied to the respective parties prior to the date fixed for hearing by the said authority.
There will be no order as to costs.
