Mr. Debjit Mukherjee, Mrs. Susmita Chatterjee, Mrs. Dipanwita Ganguly, Mr. Kaustav Bhattacharya ...for the petitioner A direction to secure expeditious disposal of an interlocutory application, filed by the petitioner/plaintiff seeking police assistance for the implementation of an order of ad interim injunction granted by the trial court, is the ultimate relief sought for in this case.

Mr. Mukherjee, learned advocate appearing for the petitioner submits that petitioner/plaintiff has already been favoured with ad interim order of injunction on 23rd December, 2022 in Title Suit No.263 of 2022, pending before the learned Civil Judge (Senior Division), 1st Court, Tamluk.

The only contention expressed by the petitioner is against the delay caused in the disposal of such interlocutory application, filed on 25th January, 2023. No other point is raised requiring address by this Court.

In view of the nature of order proposed to be made in this case, no prior notice is considered to be necessary.

Service upon the opposite parties stands dispensed with.

Accordingly, learned Civil Judge (Senior Division), 1st Court, Tamluk, in Title Suit No.263 of 2022, is requested to ensure expeditious disposal of interlocutory application, for the urgency of the circumstances canvassed by Mr. Mukherjee, without granting unnecessary adjournment, preferably within three weeks from the date of communication of this order, if necessary upon preponing the case upon notice to the othersides.

With this observation/direction, the revisional application stands disposed of.

Petitioner is directed to make communication of this order to the learned court below as well as to the opposite parties and their learned advocate in the court below.

Urgent certified photostat copy of this order, if applied for, be given to the parties as expeditiously as possible on compliance of all necessary formalities. (Subhasis Dasgupta, J.)
