No.6 CRR 381 of 2010 In Re : Rajesh Nigania alias Rajesh Gupta Ms. Swapna Mitra........... for the respondent None appears today even on the second call on behalf of the petitioner though the respondent is represented. Record reveals that previously on 09.6.2022, 10.6.2022 and 16.6.2022 no one appeared in the matter when the matter was called on for hearing. Hence, the case record is taken up for delivering the order in absence of the petitioner.

This revision application has been filed by the petitioner in the year 2010. On perusal of the records it appears the petitioner has challenged the order dated 23rd December, 2009 passed by the learned Judicial Magistrate, 2nd Court at Barrackpore in M. Case No. 210 of 2009. Records reveals that by dint of the said order the present petitioner was directed to pay interim maintenance allowance to the opposite party No. 1 to the tune of Rs.2,000/- per month from the date of the said order as stipulated. Being aggrieved by the same the petitioner/husband has preferred the present revision petition. The impugned order shows that the Court has dismissed the petitioner's case and upheld the order of the learned Magistrate date December 23, 2009.

On perusal of the materials on records I am of the opinion that the grounds as made out in this case would not be enough to satisfy this Court to interfere into the impugned order passed by the Court below as challenged in this revision petition.

On the finding as above, I am inclined to dismiss the revision case being CRR 381 of 2010. Interim order, if any, stands vacated. Connected application, if any, stands adjudicated with the case. Urgent photostat certified copy of this order may be supplied to the parties expeditiously, if applied for.
