It appears that the petitioners were engaged under a contractor of the Bankura Zilla Parishad as Toll Tax Collectors. They had earlier approached this Court by filing WPA of 2024, seeking regularisation of their services. A Co-ordinate Bench of this Court dismissed the said writ petition by an order dated April 24, 2024, with the following observations:

"There is nothing on record to suggest that the petitioners were engaged by the Zilla Parishad to perform any work.

On the contrary, it appears that the petitioners are working under a contractor who is engaged with the Zilla Parishad.

The prayer for regularization in the office of the Zilla Parishad cannot be accepted by the court.

The writ petition is misconceived and is hereby dismissed. The petitioners are at liberty to approach the appropriate forum for their remedy."

Thereafter, the present writ petition has been filed seeking re-engagement of the petitioners against the sanctioned vacant posts under the respondent authorities. The representations, appearing at pages 28, 29, and 30 of the writ petition, are identical in nature. It appears that the petitioners now seek employment under the said authorities.

Needless to say, the concerned respondents cannot be compelled to re-engage the petitioners in the absence of any statutory obligation.

Accordingly, WPA 4153 of 2025 is dismissed.
