The revisional application was preferred challenging the order dated 30.11.2013 passed by the learned Additional Chief Judicial Magistrate, Alipore in connection with A.C. Case No. 137 of 2008, wherein the learned Magistrate was pleased to award maintenance of a sum of Rs.3,000/-.
I have taken into account the reasons assigned by the learned Magistrate and I find that learned Magistrate has considered the amount received by the present petitioner, and also taken into consideration regarding the expenses to be incurred by an individual to survive. Thereafter the award for maintenance was passed. As the order was passed after scrutiny of the materials, after assessment of the evidence which surfaced as also of the document relied in evidence, I am of the opinion that considering the present cost index which is enhanced after a period of eight years, there is no scope for interference.
Thus, the application being C.R.R. 203 of 2014 is dismissed.
All pending connected applications, if any, are consequently disposed of.
Interim order, if any, is hereby vacated.
