IN THE HIGH COURT AT CALCUTTA

Item No.37 CRIMINAL REVISIONAL JURISDICTION Ct.No.34 dc.

C.R.R. 699 of 2022 with CRAN 1 of 2022 Shyam Sel and Power Limited versus The State of West Bengal & Ors.

In Re: An Application under Section 482 of the Code of Criminal Procedure, 1973.

Mr. Ayan Bhattacherjee, Mr. Shounak Mitra, Mr. Zulfiqar Ali, Mr. Prattay Khan ... For the Petitioner.

Mrs. Anasuya Sinha, Mr. Pinak Kumar Mitra ... For the State.

Mr. Soumalya Ganguly ... For the Opposite Party No.2.

Report dated 03.05.2022 submitted by Mrs. Sinha, learned advocate appearing for the State be kept on record. The report encloses the statement of the complainant recorded under Section 161 of the Code of Criminal Procedure as well as the statement of a respectable person of the locality and the statement of the complainant recorded under Section 164 of the Code of Criminal Procedure. I find that the present case being Jamuria Police Station Case No. 142 of 2021 dated 04.04.2021 was registered under Sections 420/406/463/467/468/418/471 of the Indian Penal Code. The report so submitted and the statements which have been placed along with the report reflect that the complainant is not interested to pursue the litigation. Further, the dispute and differences between the

parties have been settled and nature of the dispute happens to be private and personal in nature without affecting any public policy.

Having regard to the nature of the proceedings as well as the dispute, I am of the opinion that further continuance of Jamuria Police Station Case No. 142 of 2021 dated 04.04.2021 (G.R.No. 1009 of 2021) is unwarranted and as such, the same is quashed.

Accordingly, the revisional application being CRR 699 of 2022 along with CRAN 1 of 2022 is hereby allowed. All pending connected applications, if any, are consequently disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
