Alok Naskar v. State Of West Bengal And ANR
C.R.R. No.703 of 2022 D/L75 June 13, Bpg.
In Re: An application under Section 401 and 482 of the Code of Criminal Procedure;
Alok Naskar
Versus
The State of West Bengal & Anr.
Mr. Prantick Ghosh, Mr. Siddhartha Sarkar.
...for the petitioner.
Ms. Anasuya Sinha, Mr. Pinak Kr. Mitra.
...for the State.
Affidavit of service filed be kept with the record. The allegations made in the letter of complaint which has been treated to be the First Information Report relate to transactions having taken place, thereby prima facie making out a case of cheating and forgery. Whether the present petitioner is involved or not is an issue at this stage of investigation to be decided by the Investigating Officer of the case. Mere plea of innocence at this stage is not sufficient to stall the investigation or scrutinize the requirement of the Investigating Officer in respect of accounts being involved. No interference is called for at this stage. Accordingly, CRR 703 is dismissed.
Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
