The petitioner claims to have applied for issuance of a quarry permit for extraction of morrum from the land in question.

The learned Advocate appearing for the petitioner submits that in spite of receipt of such representation, no decision on such representation has been communicated to the petitioner till date.

Mr. Banerjee, learned Advocate appearing for the State submits that on an earlier occasion, the petitoiner approached this Court by filing a writ petition, being WPA 4189 of 2020, which stood dismissed for default on 29th July, 2021. He submits that the writ petitioner has approached this Court after a long delay and in the meantime the 2021 Mining Policy has come into force. He further submits that if the petitioner is desirous of getting the quarry permit, he has to take steps in accordance with the Notification dated 22nd November, 2022 issued by the Department of Industries, Commerce and Enterprise, Government of West Bengal.

Faced with such situation, the learned Advocate for the petitioner submits that leave may be given to the petitioner to take steps in accordance with the Notification dated 22nd November, 2022.

Such submission is not opposed by the learned Advocate for the State.

In the light of the submissions made by the learned Advocates for the respective parties, this writ petition stands disposed of by leaving the petitioner free to take steps in accordance with the Notification dated 22nd November, 2022 or any relevant notifications governing the field for issuance of quarry permit.

If the petitioner takes appropriate steps in accordance with the relevant rules, policy etc., the respondent authorities shall consider the same and act in accordance with law. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
